These Terms and Conditions apply to the website at volairetravel.com and to services arranged by Volaire Travel & Logistics LLC, a Florida limited liability company, referred to as “Volaire,” “we,” “us,” or “our.” “You” means the person or business using our website or requesting or purchasing our services.

## 1 Our services and role
Volaire arranges travel and related services through independent providers. Depending on your confirmed booking, services may include travel packages, passenger and group air charters, private jet charters, cargo charters and AOG logistics coordination, yacht charters, chauffeur services, concierge arrangements, and special requests.
Volaire is an air charter broker. Volaire is not a direct air carrier or direct foreign air carrier and does not exercise operational control over aircraft. Air transportation is provided by properly licensed direct air carriers or direct foreign air carriers. The operating carrier controls flight operations, crew, aircraft suitability, routing, and safety decisions.
Volaire does not own or operate the yachts or ground transportation vehicles it arranges, and does not exercise operational control over them. The independent provider is responsible for vessel or vehicle operations. For other services, the identified provider operates the accommodation, venue, or activity. Our booking documents describe the services Volaire undertakes, the provider’s role, and whether we act as an agent or as a contracting principal. We remain responsible for our own obligations and for responsibilities that applicable law places on us.
Volaire Travel & Logistics LLC is the Charterer in its contracts with operating carriers. Customers are not parties to those operator-facing contracts. Volaire’s separate customer agreement defines the arrangements Volaire undertakes for the Customer; the operating carrier retains operational control. Contract labels do not override duties or rights imposed by applicable law.
2 Eligibility and authority
You must be at least 18 and legally able to enter a contract to purchase services. If you act for a business, group, traveler, shipper, or consignee, you must have authority to provide instructions and information and to accept the applicable contractual obligations on their behalf. You must provide accurate contact, itinerary, passenger, payment, and shipment details and promptly notify us of corrections.
You are responsible for giving affected travelers or other individuals the relevant booking information and our Privacy Policy. An individual’s agreement or separate authorization will be obtained where required; your role as an organizer does not automatically authorize every use of their information.
3 Applicable documents and agreement
Your transaction may be governed by these Terms, our Cancellation, Refund & Disruption Policy, a quotation or order, a signed customer service agreement, a written booking confirmation, and the relevant provider’s terms supplied before you commit. The Privacy Policy explains information handling and is not a substitute for any consent required by law.
Mandatory law controls over inconsistent contract language. A specific written agreement between you and Volaire controls over these general Terms for the matters it expressly addresses. Provider terms govern the provider’s services to the extent applicable and disclosed; they do not override Volaire’s own promises or nonwaivable duties.
Before a booking becomes binding, you will be asked to accept the applicable terms by signature, an affirmative electronic action, or another documented agreement. Visiting the website or submitting an inquiry alone does not purchase a service or authorize a charge.
4 Inquiries quotations and confirmation
An inquiry, automated acknowledgment, preliminary itinerary, or budget estimate is not a confirmed booking. Availability is checked for each request. A quotation has the validity period and conditions stated in it; if none are stated, we will confirm validity before you commit.
A booking becomes confirmed only when the required acceptance and payment conditions are met and Volaire issues written confirmation identifying the agreed services. We will not represent a specific supplier, aircraft, or itinerary as secured without the necessary binding supplier commitment. Receiving funds alone does not establish that a booking is confirmed.
If a proposed service becomes unavailable or an error is discovered before confirmation, we will explain the correction and seek your approval of any revised offer. If you decline, uncommitted funds will be returned, subject only to separately authorized work or costs that may lawfully be charged. We will not unilaterally reprice a confirmed booking except under an expressly agreed, lawful adjustment mechanism or your subsequent agreement.
5 Prices fees and additional costs
Your offer identifies the currency, services included, total amount payable to or through Volaire, known mandatory charges, payment deadlines, and any amounts payable directly to others. Unless another currency is expressly stated, our quotations are in U.S. dollars. Optional services require your agreement.
Certain costs may depend on your instructions or actual use, such as additional waiting time, extra flight time, deicing, itinerary changes, extraordinary handling, storage, permits, customs duties, or yacht provisioning. Any contractual basis for such charges, including estimates, rates, or calculation methods, will be disclosed before you commit. A general reference to “additional costs” does not authorize an undisclosed mandatory fee.
Volaire may earn a disclosed service or arrangement fee, a supplier commission, or a margin within an agreed total price. Where required, we will disclose relevant agency relationships and compensation arrangements. A combined price need not represent the supplier’s own price. Foreign exchange and bank charges imposed independently by your bank are governed by your arrangement with that bank.
6 Payments and customer funds
The booking documents state the payee, accepted payment methods, deposit, balance deadline, and the entity processing a card payment. You authorize only the amount and payment schedule that you expressly accept. Additional charges require the authorization provided in your agreement or separate consent.
Supplier commitments and cancellation charges can arise before the travel or shipment date. If an agreed payment is overdue, we may suspend unperformed arrangements or cancel as permitted by the disclosed booking terms and applicable law, after any required notice. Refundable balances remain refundable; a late payment does not automatically forfeit every amount paid.
Customer money may be paid to suppliers to secure confirmed services, subject to applicable safeguarding requirements. Your booking documents identify any legally required trust, escrow, bond, or other protection. Do not assume a payment is held in a trust or escrow account, insured against supplier failure, or protected by a particular compensation fund unless we expressly confirm that protection.
For wire transfers, verify payment instructions using an independently established Volaire contact. Tell us promptly if you suspect a payment error or fraud. Nothing in these Terms removes statutory cardholder, billing-dispute, or chargeback rights, and contacting us first is not a condition of exercising those rights.
7 Changes cancellations and refunds
Our Cancellation, Refund & Disruption Policy applies. For a voluntary customer cancellation of an air transportation booking, the amount paid for the cancelled booking is refunded less a single US$500 fee, capped at the amount paid, where disclosed, accepted and lawful. No additional supplier cancellation charge is deducted from that refund. If transportation cannot be performed because of force majeure or other factors, payments for that unperformed transportation are refunded in full without the cancellation fee. Mandatory rights to a greater refund take priority. See the policy for scope, partial itineraries and processing.
Separate non-air services may have different cancellation terms disclosed before acceptance. Supplier terms or a nonrefundable label do not override Volaire’s express air transportation refund commitments or mandatory legal rights.
8 Passenger and private jet charters
The customer booking documents identify the operating carrier, Volaire’s capacity in the transaction, the aircraft or agreed category, itinerary, passenger capacity, and other material terms. We also provide the applicable broker insurance disclosure. The applicable Conditions of Carriage and operational restrictions will be identified and supplied before you commit, as explained in our Conditions of Carriage Notice. Conditions from our separate operator agreement bind the Customer only to the extent properly incorporated into the customer agreement or otherwise applicable by law.
Aircraft images and model descriptions illustrate potential options unless expressly identified as the aircraft confirmed for your trip. Seating, baggage capacity, range, payload, cabin equipment, connectivity, and onboard services vary by aircraft and mission. Any feature essential to your decision must be included in the written agreement.
The carrier and pilot in command may make safety and operational decisions, including weight restrictions, fuel stops, diversions, and delays. We will communicate material changes and any alternatives, cancellation options, or refunds required by the contract or law. An aircraft or carrier substitution does not automatically waive your rights or authorize a materially different service.
9 Group arrangements and resale
A whole-aircraft arrangement does not by itself authorize the Customer to advertise or resell seats to the public. Tell us before contracting if individual passengers will pay directly or indirectly for transportation, if seats will be resold, or if the arrangement forms part of a tour or public charter program. Different regulatory requirements may apply.
These general Terms are not a public charter operator-participant contract. Any legally authorized public charter product must have its own program-specific disclosures, contractual documents, and required financial protections before it is offered.
10 Travel documents and passenger requirements
Travelers must meet applicable passport, visa, entry, transit, health, security, customs, and identification requirements and arrive at the stated reporting time. Requirements can differ by citizenship, residence, destination, transit point, and type of travel. Confirm them with the relevant authorities and promptly review the details in your booking.
Tell us as early as possible about accessibility needs, service animals, mobility equipment, or other assistance requests so we can coordinate with the provider. We will handle requests consistently with applicable law. Advance notice requests do not remove rights that do not lawfully depend on advance notice. We do not guarantee admission to a country or approval of an application by an authority.
11 Cargo charter and AOG coordination
Your cargo service agreement identifies the services we arrange, the contracting parties, the carrier or logistics providers, and Volaire’s role under applicable law. Volaire is the Charterer in its agreement with the operating carrier; you are the Customer in your agreement with Volaire. The responsibilities actually undertaken, applicable law, and accepted shipping documents determine the legal relationship; the word “broker” alone does not remove obligations imposed on Volaire.
Before acceptance, supply accurate descriptions, dimensions, weights, packaging and handling requirements, values, routing instructions, shipper and consignee details, and required commercial, customs, export, and dangerous-goods documentation. Disclose batteries, chemicals, engines containing fluids, restricted items, temperature requirements, high-value goods, and other special handling needs. Cargo is subject to carrier acceptance, security screening, export controls, permits, and customs release.
You must ensure the shipment is lawfully tendered and properly classified, packed, marked, labeled, and documented by qualified persons as required. We may decline or pause a request that cannot be lawfully or safely performed. We do not undertake customs brokerage, screening, warehousing, insurance placement, or physical handling unless the written agreement expressly includes that service and the responsible provider.
An AOG or urgent designation describes priority; it is not a guaranteed delivery time. Any guaranteed performance commitment must be expressly agreed in writing. Capacity, aircraft compatibility, permits, handling, weather, and government action can affect timing. Urgent cargo inquiries: +1 305-847-1510.
12 Cargo liability insurance and claims
Cargo liability may be limited by applicable law, international convention, an air waybill, or valid agreed terms. The booking and shipping documents must identify the applicable limits and claims procedures. A cargo value stated on an invoice is not, by itself, insurance or an accepted declaration increasing a carrier’s liability.
Where Volaire acts as an indirect cargo air carrier, our written shipment disclosure states whether we hold cargo liability accident insurance and the applicable limits of our liability. Carrier liability coverage, Volaire liability coverage, and a separate cargo insurance policy are different protections. No shipment-specific cargo insurance is included unless expressly confirmed in writing with the relevant coverage terms.
Inspect cargo promptly, record apparent loss or damage, preserve packaging and delivery records, and notify the responsible carrier and Volaire as soon as possible. Mandatory or agreed claim and suit deadlines can apply. Contacting Volaire does not automatically satisfy a separate notice requirement to the carrier, insurer, or another party; we will help identify the relevant claim channel.
13 Travel packages yachts chauffeurs and concierge
Your itinerary or service order identifies included and excluded services and applicable provider conditions. Package components may have different change and cancellation rules, subject to any law that gives you rights against a package organizer or retailer.
Yacht arrangements may involve a vessel-specific charter agreement, security deposit, provisioning allowance, fuel, port charges, crew arrangements, and weather provisions. Chauffeur arrangements may involve waiting time, extra stops, baggage capacity, child-seat requirements, and additional hours. Special requests remain subject to provider acceptance and lawful availability. Each applicable charge and material restriction must be disclosed in the offer or service agreement.
Separate luxury vehicle rental requests require a separate rental arrangement specifying the licensed supplier, driver eligibility, insurance, deposit, and rental conditions. They are not included in a chauffeur booking.
14 Insurance and risk information
Travel protection, medical evacuation cover, personal accident cover, and shipment insurance are not automatically included in an arrangement. If you want insurance, ask about available arrangements before making nonrefundable commitments or contact an appropriately authorized insurance provider. Policy eligibility, exclusions, limits, and claim decisions are governed by the insurer’s policy.
We do not represent that Volaire is a licensed insurance producer or that a supplier’s liability policy directly insures you. Any insurance offered through Volaire will be accompanied by the required provider, licensing, and coverage information.
15 Force Majeure
The Force Majeure section of our Cancellation, Refund & Disruption Policy forms part of these Terms. It explains qualifying events, notice, mitigation, alternatives, cancellation and refunds. No force majeure provision removes rights that cannot lawfully be waived.
16 Lawful conduct and cooperation
You must not use our services for unlawful travel, prohibited trade, sanctions evasion, undeclared dangerous goods, fraud, or conduct that endangers others. We and the provider may request information reasonably necessary to verify identity, authority, payment, or legal eligibility. A request may be declined where it cannot lawfully be fulfilled.
You are responsible for documented additional costs caused by your inaccurate instructions, failure to disclose material shipment information, or misconduct, to the extent provided by an accepted agreement and permitted by law. You are not required to reimburse costs caused by Volaire’s own breach or misconduct.
17 Responsibility and limitations
Volaire is responsible for exercising reasonable care in performing the services it agrees to provide. Independent suppliers are responsible for the services and operational decisions they undertake, subject to any responsibility that applicable law imposes on Volaire as an agent, arranger, retailer, organizer, or contracting principal.
To the extent permitted by law, Volaire is not liable for indirect or consequential business losses, including lost commercial profits or business interruption, arising from a service disruption. This exclusion does not limit express guarantees in a signed agreement, mandatory refunds, or liability for Volaire’s fraud, gross negligence, willful misconduct, or any liability that cannot lawfully be excluded. It does not exclude a consumer’s legally recoverable loss merely by labeling it consequential.
Any transaction-specific monetary liability limit must be expressly stated in an accepted agreement and remain subject to applicable law and conventions. These Terms do not impose an undisclosed cargo liability limit or transfer Volaire’s legal obligations to the customer.
18 Website content and acceptable use
Website content provides general information and examples of potential services. It is not a guarantee that a specific aircraft, route, vessel, property, vehicle, or price is available. We may correct or update website information; changes to an existing booking require the process described in your agreement.
You may use the website for lawful inquiries and personal or authorized business purposes. Do not interfere with its security, attempt unauthorized access, submit malicious files, impersonate another person, or misuse personal information. Volaire and its licensors retain rights in their logos, text, photographs, and other protected content. You may save your own quotes and booking records and exercise any use permitted by law.
19 External links and referrals
Third-party websites and platforms have their own terms and privacy practices. A link does not mean Volaire controls the linked service. Where we receive compensation for a referral or affiliate link, we will disclose the relationship clearly near the relevant recommendation or link. A referral does not itself confirm a booking with Volaire.
20 Communications and electronic records
We may use the contact details you provide to respond to your request, deliver documents, and communicate about your arrangements. If you choose to contact us through WhatsApp or another platform, that platform’s terms and privacy practices also apply. Do not send full card details, passwords, or unnecessary identification documents through an ordinary contact form.
Marketing permission is separate from a service inquiry or booking. You can opt out of marketing without cancelling your trip or shipment. With your agreement, quotes and contracts may be delivered and accepted electronically. You may request a copy of your accepted documents at contact@volairetravel.com.
21 Complaints and disputes
Please send a complaint to contact@volairetravel.com with your booking reference, relevant dates, and the resolution you seek. We will review it and coordinate with the relevant provider where appropriate. This contact procedure does not prevent you from contacting a regulator, exercising payment rights, or commencing a claim within an applicable deadline.
Florida law governs these Terms to the extent it is not displaced by applicable federal law, international conventions, or mandatory consumer protections. Unless a valid specific agreement or mandatory law provides otherwise, disputes may be brought in a court with jurisdiction in Miami-Dade County, Florida. Consumers retain any nonwaivable right to bring proceedings in another forum. These Terms do not require binding arbitration or waive participation in a class action.
22 Updates and remaining provisions
We will post an updated effective date when these Terms change. Revised Terms apply prospectively and do not change an existing booking without the agreement or notice required by its contract and applicable law. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision on one occasion does not waive it for every occasion.
